DUI DOL Penalties and Process

If you have been arrested for the offense of Driving Under the Influence and your breath test is over .08% (.02 or higher for minors - under the age of 21) or you refused the breath test, the Department of Licensing will take an Administrative action on your privilege to drive in Washington State. It is important to remember, the administrative action is completely separate from any possible criminal case pending against you.
You have the right to challenge this suspension, but it is your responsibility to request a hearing. Effective January 1, 2009, you only HAVE 20 DAYS FROM THE DATE OF ARREST TO REQUEST A HEARING; if you fail to request a hearing your license will be suspended or revoked. Please note a suspension/revocation happens whether or not you have been charged in court with a DUI.

Breath Test .08% or Higher
First Administrative Action Against License:
- 90 day License Suspension
- May be eligible for Ignition Interlock License - for period of license suspension
- Requirements for Reinstatement of Driving Privilege:
- Pay $150 reinstatement fee
- SR-22 Insurance - 3 years
Second or Subsequent Administrative Action Against License:
- 2 year License Revocation
- May be eligible for Ignition Interlock License - for period of license revocation
- Requirements for Reinstatement of Driving Privilege:
- Pay $150 reinstatement fee
- SR-22 Insurance - 3 years
- Pass Driver's Ability Test
Refusal to Take Breath Test
First Administrative Action Against License:
- 1 year License Revocation
- May be eligible for Ignition Interlock License - for period of license revocation
- Requirements for Reinstatement of Driving Privilege:
- Pay $150 reinstatement fee

- Pass Driver's Ability Test
