Q: How long will it take to obtain an IIL?
A: This depends on the Department of License's processing time. You should consult with an attorney immediately to determine the best course of action for you situation and case and if applying for an IIL is appropriate in your case.
Q: How long do I have to have the ignition interlock license if my license is suspended/revoked due to an administrative action by the DOL?
A: There is no requirement that you apply for an IIL pursuant to the a loss of license under RCW 46.20.308. However, if you want to drive you will be required to have the ignition interlock license for the length of the suspension/revocation.
Q: How long do I have to have the ignition interlock license if I am convicted of a alcohol related DUI or Physical Control?
A: If you are convicted of a alcohol related DUI or Physical Control, the court shall order you to apply for the IIL as part of the conditions of his or her sentence.
- For a first offense, IIL for 1 year;
- For a second offense - IIL for 5 years; and
- For a third or subsequent offense - IIL for 10 years
Q: What if I do not have or own a vehicle?
A: There is no requirement that you apply for an IIL pursuant to the a loss of license under RCW 46.20.308. However, if you are convicted of a DUI or Physical Control, the court shall order you to apply for the IIL as part of the conditions of his or her sentence. The court can waive this requirement but "shall order the person to submit to alcohol monitoring through an alcohol detection breathalyzer device, transdermal sensor device, or other technology designed to detect alcohol in a person's system." RCW 46.61.5055(5).
Q: If I was convicted of an alcohol-related DUI, can I get an Occupational/Restricted License instead of an IIL?
A: No, you may drive only if you have an IIL and an interlock device installed on your car. The Occupational/Restricted License (ORL) isn't available to drivers who have been convicted of DUI.
Q: What if I own more than one vehicle?
A: You must install an interlock device in all the cars you drive, but aren't required to install one in all the cars you own. If you prefer, you may install an interlock device in one of your vehicles and drive only that vehicle while your license is suspended.
Q: What happens if a driver violates the terms of the Ignition Interlock License?
A: It is a criminal offense punishable up to 6 months in jail and up to a $2,500.00 fine pursuant to RCW 46.20.410.
Q: If my commercial driver's license has been disqualified due to a DUI, can I drive a commercial vehicle with the IIL?
A: No, unfortunately the IIL is not available for commercial vehicles.
